1. Acceptance and Scope of These Terms

By accessing or using the Foldque mobile application, website, and related features and services offered by Foldque (collectively, the “Service”), you agree to be bound by these Terms of Service. Please review our Privacy Policy to understand how personal data is processed and our Community Guidelines for platform conduct rules.

Certain features may be subject to additional conditions, technical limitations, or app-store rules. Nothing in these Terms limits rights that cannot lawfully be waived under applicable consumer, privacy, or other mandatory law.

2. Accounts and User Responsibility

You are responsible for activity carried out through your account, for maintaining the security of your account credentials, and for keeping information you provide to Foldque accurate and reasonably up to date. You may not use an account to impersonate another person, engage in unlawful activity, or circumvent platform security.

Foldque is designed for users aged 16 and older. Please see our Privacy Policy for additional information regarding age requirements.

3. User Content, Ownership, and the License You Grant Foldque

You retain the intellectual property rights, if any, that you hold in questions, solutions, images, drawings, explanations, messages, and other content that you upload to or create through the Service (“User Content”). These Terms do not transfer ownership of your User Content to Foldque.

To operate the Service, you grant Foldque a worldwide, non-exclusive license, limited to providing and operating the Service, to host, store, back up, technically reproduce, transmit, display, resize, compress, convert, format, create previews or thumbnails of, process for security and moderation, and make your User Content available to other users or to the public in accordance with the features and visibility/sharing settings you choose. This license also permits Foldque to use service providers and technical processors as necessary to provide the Service.

This license does not mean that Foldque may sell your User Content as a standalone work or that Foldque acquires ownership of it. The license is limited to operating and securing the Service, applying your visibility and sharing choices, and providing outputs or features you request, such as a question archive, team sharing, test/PDF generation, or similar functionality.

4. Visibility, Sharing, and Public Content

Depending on the feature you use and the visibility setting you choose, content on Foldque may be available only to you, to selected users or groups, or publicly. Sharing content with a limited person or group does not, by itself, make that content public.

If you expressly publish User Content publicly or use a feature that makes content publicly available, that content may appear on Foldque’s public web pages, in links, previews, and search features, and may be crawled, cached, and indexed by search engines. Foldque may not control how quickly search engines or other third-party services update or remove their caches or indexes.

Foldque does not intend to make content marked private or limited-access publicly available except to the extent necessary to operate the Service, provide a sharing action you initiate, maintain security and moderation, or comply with legal obligations.

5. Rights and Permissions for Content

You must have the rights, permissions, and other lawful basis necessary for User Content that you upload, share, or make public. You may not upload or unlawfully share content that infringes third-party copyright, trademark, privacy, publicity, personality, or other intellectual property or legal rights.

Using material for educational purposes does not automatically give you the right to reproduce it or make it publicly available. In particular, systematic copying, distribution, or unauthorized public availability of all or substantial portions of books, question banks, practice exams, course materials, or teacher/institution materials is prohibited.

If a third party submits a rights-infringement claim concerning your content, Foldque may restrict access to or remove the content in accordance with applicable law and our Copyright and Intellectual Property Infringement Notice Policy. To the extent permitted by applicable law, users remain responsible for their own unlawful acts.

Content containing personal data: Foldque is a question-and-solution archiving platform. Question and solution images, drawings, and explanations may therefore be stored and processed as core Service content as described in these Terms. However, you should not include unnecessary personal information about yourself or other people in questions, solutions, images, drawings, explanations, messages, or other content. Before uploading, remove, crop, or obscure information such as full names, faces, phone numbers, email addresses, home or school addresses, student numbers, signatures, government identification numbers, health information, or other personal or sensitive information. Do not upload, share, or make public another person’s personal data without an appropriate lawful basis or permission. To the extent permitted by applicable law, users are responsible for their own unlawful disclosures; this does not eliminate Foldque’s mandatory obligations under applicable data protection law.

6. Acceptable Use

You must comply with our Community Guidelines. Prohibited conduct includes content that endangers child safety, harassment, hate speech, exam-security violations, fraud, spam, malware, unlawful disclosure of personal data, and infringement of third-party rights.

7. Moderation, Content Restrictions, and Account Actions

To protect the security, integrity, and lawful operation of the Service, Foldque may, subject to applicable law and these Terms, review content, apply automated or manual controls, limit visibility, take technical steps intended to prevent search-engine indexing, disable access, or remove content.

Foldque may also restrict access to features and, depending on the nature or repetition of a violation, temporarily suspend or terminate an account. Action may be taken without prior notice where reasonably necessary for urgent security risks, legal obligations, valid rights-infringement notices, or serious violations. Where appropriate and practicable, Foldque may inform the affected user of the action taken.

8. Intellectual Property Infringement Notices

Foldque respects intellectual property rights. If you believe material available through Foldque uses your work or other protected material without authorization, you may submit a notice using the process described in our Copyright and Intellectual Property Infringement Notice Policy. Repeat or serious infringement may result in content removal, feature restrictions, suspension, or account termination.

Subject to liabilities and rights that cannot lawfully be excluded or limited, Foldque will not, to the maximum extent permitted by applicable law, be liable for indirect, incidental, special, consequential, or punitive damages arising from access to, use of, or inability to use the Service. Nothing in this section limits non-waivable consumer or statutory rights.

11. Changes to the Service and These Terms

Foldque may change, add, or remove features to improve the Service, maintain security, or comply with technical or legal requirements. These Terms may also be updated from time to time. Where a change materially affects user rights, Foldque will provide notice through the app, website, email, or another appropriate method where required by applicable law.
